Wto Bilateral Trade Agreements

Although it is not at the centre of this chapter, it is worth considering two other types of “multilateral” agreements that attract attention. These would be possible alternatives to multilateral negotiations subject to the WTO consensus rule, which allows any member to block an agreement, or to bilateral and regional agreements outside the WTO. The study of these options has intensified since the Doha Round of WTO negotiations, launched in 2001, fell into its current zombie state – not alive, but not completely dead and buried. In particular, agreements should help to make trade between ATR countries freer without barriers to trade with the outside world. In other words, regional integration should complement, not threaten, the multilateral trading system. A free trade agreement (FTA) or treaty is a multinational agreement under international law to create a free trade area between cooperating states. Free trade agreements, a form of trade pacts, set tariffs and tariffs on imports and exports by countries, with the aim of reducing or removing barriers to trade and thereby promoting international trade. [1] These agreements “generally focus on a chapter with preferential tariff treatment,” but they often contain “trade facilitation and regulatory clauses in areas such as investment, intellectual property, public procurement, technical standards, and health and plant health issues.” [2] First, tariffs and other rules applicable to trade with non-parties to this free trade area in each of the parties that signed a free trade area in force at the time of the creation of this free trade area must not be higher or more restrictive than tariffs and other rules applicable in the same signatory countries prior to the creation of the free trade area. In other words, the creation of a free trade area to give preferential treatment to their members is legitimate under WTO law, but parties to a free trade area are not allowed to treat non-parties less favourably than before the creation of the territory.
